What Is the Kahnawake Gaming Commission?

The Kahnawake Gaming Commission (KGC) is the gambling regulatory and licensing authority of the Kahnawake Mohawk Territory — a self-governing First Nations reserve situated on the south shore of the St. Lawrence River, approximately 15 km southwest of Montreal, Québec.

The KGC was established in 1996 after the adoption of the Kahnawake Gaming Law by the Mohawk Council of Kahnawake. It operates outside of Canadian federal and province of Quebec jurisdiction through the framework of Mohawk self government. The jurisdictional exception which has allowed an online gaming certification company to approve hundreds of online gaming websites for nearly 30 years free of interference by Canadian authorities.

1993–1995

Mohawk Council Explores Gaming Authority

During the early 1990s the Mohawk Council of Kahnawake began to investigate a system of regulation that would allow them to permit and control on-line gaming activities coming from their territory on the World Wide Web. The Mohawk band council exercises jurisdiction under a system of indigenous self-government provided by their own laws and customs, outside the jurisdiction of federal and provincial gaming authorities.

1996

Kahnawake Gaming Law Enacted

The Mohawk Council, the ruling body of the reserve that has long been a focal point of the land claims issue, voted to pass the Kahnawake Gaming Law in August 1996. The law mandated that all gambling activity occurring from the reserve must adhere to a new set of strict rules and be regulated and governed by a commission created by the council — the Kahnawake Gaming Commission (KGC). At the end of November 1996, KGC officials were issuing Interactive Gaming Licences and Client Provider Authorisations. In fact, the KGC ended up being one of the first regulatory bodies in the world for online gambling.

1999–2005

Rapid Expansion — Hundreds of Operators Licensed

The Kitigan Zibi Commission became one of the world's largest online gambling licence issuers, with hundreds of casinos, poker rooms and sports bookmaking sites operating from hardware located on the Kahnawake servers or with a KGC licence. In the boom days, the Commission hosted servers for such major international online casinos as the original PokerStars site and PartyPoker.

2010

PokerStars & Major Operators Depart

In 2010 the enforcement of the US UIGEA caused a change in the international online gambling laws and several major operators such as PokerStars and Full Tilt Poker moved away from Kahnawake servers and onto Isle of Man and Maltese servers. The KGC switched from being a hosting company to that of a licensing and regulatory body for a wide variety of international gaming operators.

2012

KGC Policy Clarification on Canadian Players

The KGC issued a clarification stating that its licensees could continue to accept players from Canada, based on the fact that the KGC is an indigenous organization operating under the laws of the Mohawk reserve, as opposed to Canadian federal or provincial gambling law. This policy has stood, and was not disputed by the Canadian authorities.

2017–2020

Regulatory Modernisation

In 2017, the Gaming Regulator published amendments to the Regulations to Prevent and Combat Money Laundering and Terrorist Financing; increased the Anti-Money Laundering obligations on licence holders; and implemented stricter player protection rules so that they are in line with international best practices.

2022–2026

Continued Operation Alongside Ontario's iGO Market

On 4 April 2022, the iGO market for online gaming launched in Ontario. Under this model, the KGC will continue to licence operators to offer online gaming in the Canadian market including in Ontario. Many of Canada's online casinos, both those based in Canada and internationally, hold licences from the KGC and, in some cases, also hold a licence from Curaçao for offering online gaming to players in Canada. This means that there are two parallel regimes operating in Canada in 2022: iGO in Ontario and the KGC in the rest of Canada.

Legal Basis: Mohawk Self-Governance

The KGC's ability to function as a stand alone gaming regulatory body is based on the principles of Mohawk government. The Kahnawake Mohawk Territory is a federally designated First Nations reserve. The laws enacted by the Mohawk Council, including gambling laws, are enacted pursuant to Section 35 of the Constitution Act, 1982 which recognizes and affirms existing Aboriginal and treaty rights in Canada, and the inherent jurisdiction of First Nations as recognized under Canadian constitutional law.

Kahnawake Gaming Law, s.1(a): "The Mohawk Council of Kahnawake, pursuant to its inherent authority as a government, and in order to protect the health, safety and welfare of the Kahnawake community, hereby enacts this law to regulate gaming activities conducted by or on behalf of the Mohawks of Kahnawake..."

KGC Licence Types

The KGC issues several types of authorisations depending on the nature of the gambling operation. As a player, understanding which type of authorisation your casino holds helps you assess the level of regulatory coverage you have.

This is typically the standard licence for Online Casinos. This licence is required for companies that operate an online poker network or poker room. It was more common years ago as PokerStars for example was originally licenced in Kahnawake, however the majority of Poker Network Operations have now moved to MGA and UKGC jurisdictions. A few Crypto Poker Rooms still fall under the KGC poker authorisations.

Client Provider Authorisation (CPA)

This licence is applicable to software providers, platform developers and third party service providers who supply technology to KGC-licensed casinos. A CPA licence does not allow for direct interaction with gamblers. Instead, it enables the gambling technology to be supplied to licensed casinos.

KGC Standards & What They Require

The KGC has established regulatory standards that each licensed operator must follow. The standards are not as stringent as the AGCO's Registrar's Standards that we enforce in Ontario, but provide a fundamental level of protection for Canadians.

What KGC Licensees Must Do

  • Fair gaming certification: Games must be tested and certified by an approved independent testing laboratory (e.g., eCOGRA, BMM, iTech Labs) to confirm RNG integrity and accurate RTP
  • Player fund protection: ensuring that the operator has put adequate controls in place to ensure that player funds are held separately from business operational accounts and that winnings and valid withdrawals are paid out in a timely manner.
  • AML compliance: Licensees are required to implement Anti-Money Laundering policies and procedures, including rules and practices for transaction monitoring and reporting suspicious transactions, as set out in KGC's AML regulations, as amended in 2017
  • Responsible gambling tools: Operators must provide self-exclusion options and responsible gambling information to players
  • Dispute resolution participation: A licensed operator must participate in the KGC's player dispute resolution process and must at all times comply with any requirement to respond to an inquiry of the KGC within the time period referred to in the inquiry.
  • Annual reporting: Operators shall submit annually to the KGC their compliance report assuring that the operation is still in compliance with the Gaming Law and Regulations

What the KGC Does NOT Mandate

  • Full mandatory KYC at registration — individual licensees set their own identity verification policies (which is why many KGC-licensed casinos are no-KYC or light-KYC)
  • Maximum withdrawal limits set by the online casino operator. These cannot be changed by the KGC.
  • Bonus wagering requirement caps - The KGC does not set a cap on the wagering requirement for a given casino bonus
  • Advertising standards unique to a Canadian province beyond federal requirements.
